The War Crimes Chamber of the Court of Bosnia and Herzegovina, which began its work 9 March 2005, has been the most significant national effort in Bosnia and Herzegovina to investigate and prosecute persons allegedly involved in serious violations of international law during the 1992–1995 conflict. It also has given the legal community useful experience with a “hybrid” court in which international and national judges serve together.

The application of transitional justice mechanisms, such as war crimes trials and reparations, has significant flaws in Serbia. Lack of progress may be even greater in truth-seeking and vetting of public officials. Serbia must do much more in all areas of transitional justice, for its own sake and the sake of long-term regional stability.

ICTJ provides an overview of investigative reports into detention and interrogation practices by the U.S. government. The purpose of this brief is to provide a sampling of reports to survey the ways in which these have been commissioned, what they have covered, and how they relate to other, similar efforts within the same system.

While a pardon application process exists within the Department of Justice, the president is free to issue pardons without regard to the process and for any reason, including a desire to shield members of his administration and the military from investigations.

More than 30 countries have created truth commissions to investigate and report on human rights abuses. These commissions of inquiry help seek recognition for victims and promote possibilities for peace, reconciliation and democracy.

Of the more than 30 truth commissions created since the 1980s, four that were organized in Africa and the Americas are notably good examples of how circumstances in each society helped shape the commissions’ work.

The European Union has an extensive commitment to peacebuilding. This includes the whole range of relevant EU activities, from facilitating peace agreements and crisis management under the Common Foreign and Security Policy (CFSP), to short, medium, and long-term peacebuilding programmes with international bodies, third country governments, local authorities and civil society organisations supported by the European Commission.

This report examines the role of women in the implementation of international peace and security instruments through a case study of transitional justice mechanisms in the Liberian context. The experiences of Liberian women have much to teach the world about women’s role in peacebuilding—not only were women strategic in influencing Liberia’s 2003 Comprehensive Peace Agreement (CPA), but Liberia also boasts the first elected woman head of state on the African continent.

To date there has been limited judicial accountability for crimes committed by the Indonesian military forces in Aceh despite compelling evidence of their involvement in mass crimes. Commitments that were part of the 2005 Helsinki Memorandum of Understanding, to establish a truth and reconciliation commission and a human rights court, have not been fulfilled.

Despite considerable progress, rising tensions between and among various actors have illuminated the need to evaluate peace-building efforts from a transitional justice perspective. This report, based on research conducted by ICTJ and Acehnese civil society, aims to provide such an evaluation, paying particular attention to the voices of victims.
