Some habits die hard. This is especially true of ways of thinking. Despite significant changes in national and international law and practice in the last thirty years—the period that corresponds with the emergence of transitional justice as a field—the recent upheaval in the Middle East and Northern Africa region has provoked proposals that hearken back to a period that we may have thought long gone.

As the number of victims of violence against demonstrators in Syria, Yemen, Bahrain and elsewhere in the region rises, a question emerges for the government of Bashar al-Assad of Syria, but also those of Ali Abdullah Saleh of Yemen, Hamad bin Isa al-Khalifah of Bahrain and the vacillating international community: Can impunity for such crimes be permitted in this day and age?

The International Criminal Court (ICC) must better communicate what is driving its actions to the public of the Middle East and North Africa (MENA) and elsewhere around the world if it is to develop confidence in its capacity to act as a guardian of international criminal law.

The appearance of Hosni Mubarak in the opening of his trial this week reassured millions of Egyptians that their revolutionary struggle was not in vain. But the truth about Mubarak’s ability to participate in his trial is still unclear. With the public doubting the court’s seriousness, Mubarak’s appearance could have been a political decision aimed at boosting confidence. This year’s Annual Emilio Mignone Lecture on Transitional Justice, coordinated by ICTJ and the Center for Human Rights and Global Justice at the NYU School of Law, focused on the intersection between transitional justice and international development.

NEW YORK, Dec. 14, 2011—ICTJ welcomes the election of Fatou Bensouda of Gambia as the next prosecutor of the International Criminal Court (ICC). Ms. Bensouda was unanimously elected December 12 by the Assembly of States Parties (ASP) during its 10th session in New York City, and will be the court's second prosecutor, commencing in June 2012.

As ICTJ co-hosts a discussion on complementarity on the margins of the Assembly of State Parties (ASP) of the International Criminal Court (ICC), the principle of ensuring accountability for serious crimes has seen a major breakthrough at a recent high-level meeting at Greentree. The meeting brought together international justice actors, development practitioners, UN representatives, and national rule of law actors to discuss the practical implementation of complementarity and how to strengthen domestic systems seeking to investigate serious crimes.

A two-day roundtable discussion on a draft law on the missing and forcibly disappeared persons was held February 24–25 in Beirut, Lebanon. Organized by the Committee of the Families of the Kidnapped and Disappeared in Lebanon, Support of Lebanese in Detention and Exile (SOLIDE), Act for the Disappeared, and ICTJ, the roundtable was part of the project “Lebanon’s unaddressed legacy: the missing and the families’ right to know,” funded by the European Union (EU) and the Embassy of Switzerland in Lebanon.

Lebanon has yet to seriously address the issue of thousands of people who went missing or were forcibly disappeared during the country’s civil war. ICTJ spoke with Lebanese activists to discuss a recent initiative taken by the families of the missing and civil society organizations to create a draft law on the missing.

NEW YORK, March 22, 2011—The International Center for Transitional Justice (ICTJ) congratulates Pablo de Greiff, director of ICTJ’s Research Unit, on the nomination as the first UN Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence of serious crimes and gross violations of human rights.

Last month ICTJ, with Saint Joseph University’s Modern Arab World Research Center and UMAM Documentation and Research launched the website “ Badna Naaref” (We Want to Know). This oral history project conducted by students tells the stories of suffering and survival during the war in Lebanon, serving both to commemorate and educate.

It is an honor and a privilege for me to be with you for this important national conference. One year ago, on this exact same date, just three months after the Tunisian people impressed the world by peacefully ending decades of repression, I had the pleasure to speak at a conference ICTJ organized here in Tunis together with the Arab Institute for Human Rights, the Tunisian League for Human Rights and the UN Office of the High Commissioner for Human Rights. It was an important and lively debate on how to address the legacy of the past and move forward.

The National Conference to Launch a Dialogue on Transitional Justice in Tunisia was held on Saturday, April 14 in Tunis, initiating a process which should result in the adoption of a comprehensive law on transitional justice by the country’s National Constituent Assembly. ICTJ president David Tolbert delivered a keynote address.

Transitional justice, at the core of its mission, strives to “break the ground on a future of peace and stability.” For countries with a violent or repressive past—and this can be said of most—implementing truth-seeking, criminal justice, reparations, and institutional reform measures forms the basis for establishing a culture of justice and respect for the rule of law.
