ICTJ’s partner Afghanistan Human Rights and Democracy Organization (AHRDO) recently opened a new virtual museum and database dedicated to Afghan victims of conflict and human rights abuses. “The Afghanistan Memory House” not only preserves the memory of these victims but helps pave the path for truth and justice. To launch the virtual museum, ICTJ and AHRDO cohosted a panel discussion on memorialization, moderated BBC journalist Lyse Doucet, in ICTJ’s office in New York this past December.

On June 25, President of the Philippines Rodrigo Duterte publicly proposed arming civilian supporters in his war on drugs. His statement comes barely a week after the International Criminal Court’s (ICC) outgoing prosecutor, Fatou Bensouda, announced her request to open an investigation into crimes against humanity related the Philippines’ war on drugs. This step has been long-awaited by victims of the drug war. Nonetheless, the ICC case should be part of a larger, more strategic fight for justice in which the needs, safety, and future of the predominantly poor families victimized by the drug war are central and just as important as naming, shaming, and prosecuting the perpetrators and abettors of these crimes.

This year marks ICTJ’s 20th anniversary. For the past two decades, the organization has engaged in more than 50 countries, providing technical assistance and other critical support to victims, civil society, governments, and other stakeholders. Since its beginnings, ICTJ has served as a meeting point for transitional justice experts and practitioners and a hub of knowledge, research, and analysis. As a think tank that does, it has been at the forefront of the field’s evolution.

2020 was a year of unforeseen hardships throughout the world. We may wish to write off last year as a loss and move forward. However, looking back on it as we do in this 2020 Year in Review, in which we highlight our most read content, we can find and take heart in important victories and apply lessons learned in 2021 and beyond.

In Venezuela, there is now an absence of representative democracy and a vacuum of public trust in politicians. However, this situation presents an opportunity for other actors and other approaches, so far disparaged by hardliners on both sides. Civil society organizations, which have earned credibility through their dedicated work addressing the humanitarian crisis and defending human rights, can seize this opportunity.

The political crisis in Venezuela has reached a breaking point. The upcoming parliamentary elections scheduled for December 6 threaten to deprive the opposition of its institutional foothold, on which the legitimacy of its demand to establish an interim government rests. Moreover, observers both inside and outside Venezuela have repeatedly warned that the conditions are unsuitable for fair and impartial elections. A political solution now depends on the government backpedaling from its recent refusal to postpone the elections and allowing the European Union to observe them. It also requires the opposition to take a clear stance beyond calling for the removal of the president.

As UN member states convene virtually this week for the annual General Assembly, they will likely focus on a narrow list of agenda items, topped by issues related to the deadly coronavirus pandemic and a global economic downturn. For this reason, ICTJ would like to recall the vital importance of justice for global peace, security, health, and development by sharing findings from an analysis of the open debate on transitional justice that the UN Security Council held on February 13, 2020, as part of its peacebuilding and sustaining peace agenda.

The role of police in society is to protect residents and enforce the rule of law. As a public institution, and particularly one whose function includes the state-sanctioned use of force, the effectiveness of the police depends on its integrity and legitimacy. When the police abuses its power, by brutalizing civilians and or engaging in corruption, it loses its credibility and the public’s trust. In Kenya, enforcement of measures to halt the spread of COVID-19 have been accompanied by acts of police brutality, of the kind that Kenyans have been through multiple times before.

Sparing almost no corner of the world from its wrath, the COVID-19 pandemic has now spread to every country. In an effort to slow the contagion, governments in most countries have been taking drastic measures requiring all residents other than essential workers to confine themselves in their homes, and shutting down vast sectors of their economies. The impact has been crushing. COVID-19 has profoundly affected every country where ICTJ currently works: Armenia, Colombia, Cote d’Ivoire, Ethiopia, Gambia, Kenya, Lebanon, Libya, Sudan, Syria, Tunisia, and Uganda. We recently caught up with ICTJ’s heads of country programs to learn more about the impact the pandemic is having on transitional justice and society more broadly.

Given the political challenges emerging from authoritarian states and conflicts in Africa, what is the best way to pursue accountability for violations of international human rights and humanitarian law on the continent? ICTJ experts Chris Gitari and Howard Varney sit down to discuss regional initiatives, complementarity, and other strategies for pursuing accountability.

On February 14, Kenyans once again confronted their painful relationship with law enforcement and revisited the deep mistrust born of historical abuses. In an unprecedented ruling, a court found five senior police officers potentially culpable in gruesome murder during the police response to the 2017 post-election protests. On the same day, a senior police officer was convicted of murder and jailed for life.

Many countries have endured a violent past or a dictatorship that left behind a trail of human rights violations. During transitions to peaceful societies or democracies, there is a need to address that painful past to ensure that the violations do not recur in future. While some countries have made or are making laudable efforts to deal with the atrocities of the past, others like Kenya are regrettably still at the phase of wishing the painful past away.

In July, ICTJ’s Program Director Anna Myriam Roccatello and Senior Transitional Justice Expert Ruben Carranza traveled to Yerevan to meet with civil society organizations, human rights and anti-corruption activists, and key government officials, to join them in exploring strategies for change.

With enforced disappearances on the rise, ICTJ President David Tolbert says the path to prevention is clear: the international community must reorder its priorities and change its approach. The disproportionate attention on counterterrorism takes us further away from accountability and prevention, Tolbert writes. He urges the international community to lead the way in unequivocally censoring governments that use enforced disappearance as a political tactic — and ensuring there can be no impunity for this crime.

ICTJ released a briefing paper today examining current opportunities for prosecuting serious crimes within Kenya’s national judicial system, including crimes committed during the postelection violence of late 2007 and early 2008 (PEV), which claimed 1,113 lives and displaced an estimated 660,000 people. Titled “Prosecuting International and Other Serious Crimes in Kenya,” the paper looks at legal and institutional reforms that may be needed at the national level to effectively investigate and prosecute the worst crimes of the PEV period, including murder, serious assault, and rape.

In a major effort to promote accountability for serious crimes in Africa, ICTJ joined hundreds of human rights groups and transitional justice partners to ask the African Union to prioritize justice. Addressed to the new African Union (AU) Chairperson Dr. Nkosazana Dlamini-Zuma, the letter warns that strained relationships between the AU and the International Criminal Court (ICC) may put justice at risk.

As attested by the arrest on January 3, 2013 in the United Kingdom of Kumar Lama, a Nepali Army Colonel suspected of torture, the government of Nepal’s failure to pursue truth and accountability for conflict-era violations can have serious consequences. Rather than resisting UK efforts to implement its obligations under international law, the Nepali government should develop a full transitional justice programme and redouble its efforts to provide truth, justice and reparations inside the country.

Forced disappearance is a crime against humanity. The decisions made by politicians and officials authorizing such practices in different countries cannot be justified legally or morally. They must be held to account and be shown for what they are: enemies of a civilized society.

As the world marks August 30, the International Day of the Disappeared, we are reminded that forced disappearances and transitional justice share a common history. Indeed, processes working in concert that came to form the field of transitional justice were born from the search for truth and justice about the disappeared.

On August 9, 2012, UN Special Rapporteur on the promotion of truth, justice, reparation, and nonrecurrence Pablo de Greiff presented the first annual report to the Human Rights Council. The report provides an overview of key activities undertaken by the Special Rapporteur between May 1 and July 25, reviews the foundations of the mandate and outlines the strategy for its implementation.

When 26-year old Tunisian street vendor Mohamed Bouazizi incinerated himself on December 17, 2010, his act resonated across an entire region and sparked what is known as the Arab Spring.
