ICTJ welcomes the 6th National Event of Canada's Truth and Reconciliation Commission, part of the TRC’s journey towards completion of its mandate: to learn the truth about what happened in the residential schools, and to inform all Canadians about this history.

“Residential schools affected everything about how we live. They targeted and destroyed our strong family unit, the basic foundation of our communities. They destroyed the glue that holds us together—love, respect and sharing.” These words, spoken by Charlie Furlong, a community leader of the Gwich'in people of Canada’s Northwest Territories, sum up the chilling legacy of the country’s policy of forced assimilation of indigenous cultures implemented through a system of Indian Residential Schools (IRS) from the 1870s to 1998.

From March 27 to 30, some 20,000 Canadians gathered in Edmonton, Alberta, for the final national event of the Truth and Reconciliation Commission of Canada (TRC). Established in 2008, the TRC is now entering a new stage: the writing of its final report based on the more than 6,500 statements it has gathered.

Canada’s Truth and Reconciliation Commission (TRC) released its interim report and a new historical publication titled They Came for the Children in Vancouver today. The TRC was established in 2008 to examine and make public the truth about Canada’s former Indian Residential Schools, a system designed to forcibly assimilate aboriginal children. From 1874 to 1996 more than 150,000 children were taken from their families and placed in church-run schools. They were prohibited from speaking their native languages and practicing cultural traditions, and physical, sexual, and emotional violence was commonplace.

In the quest to bring perpetrators of massive crimes to justice, international courts should be considered only as a last resort. Efforts to establish rule of law require the development of national capacity to prosecute the most serious crimes. It may seem trivial for me to write about why those who continue to mark July 17 as "International Justice Day" should finally stop calling it that. After three years on trial and a total of seven in detention, Thomas Lubanga gained the dubious notoriety of becoming the first person to be convicted by the International Criminal Court (ICC) in The Hague. It would be encouraging if the court, including the prosecution, indicated it saw Lubanga’s judgment as an opportunity to learn critical lessons as well as celebrate a historic day in international justice.

In July, the ICC Trial Chamber II rejected victims’ reparations claims in an appeal of the ruling for Germain Katanga, brought by five descendants of the 2003 Bongoro massacre who had suffered psychological harm. A new report by the International Center for Transitional Justice analyzes the Congolese judicial authorities’ response to international crimes committed in the territory of the Democratic Republic of the Congo from 2009 to 2014, with a particular focus on the war-torn east (North Kivu, South Kivu, and Ituri). It finds that the number of open investigations into international crimes is very low compared to the large number of atrocities being committed.

The Canadian Truth and Reconciliation Commission (TRC) will hold its second of seven national events from June 28 to July 1 in Inuvik, Northwest Territories. Germain Katanga, a warlord convicted by the International Criminal Court (ICC) for murder and other crimes, thought he was getting released from prison in January. Instead, authorities in the DRC have held Katanga following the conclusion of his ICC sentence and are now trying him on charges not originally addressed by the ICC. This represents a major step by the national judiciary in assuming its responsibility to prosecute international crimes.

“Judgment Denied,” a report from the ICTJ, details four military court cases in the Democratic Republic of the Congo involving dozens of victims, egregious human rights violations, and nearly $1 million in outstanding awards owed by the government. In every case, serious crimes were committed against civilians by members of the Congolese Army, but the government has yet to pay compensation ordered by the courts.

In this opinion piece, ICTJ's Sharanjeet Parmar asks: why do international efforts to tackle impunity for sexual violence in the DRC continue to miss the mark? High-level diplomatic visits are important in underscoring the responses needed for sexual violence survivors. However, without a strong political commitment from top Congolese authorities to address rampant impunity for sexual violence, no amount of attention or media coverage will reduce the violence or put an end to the cycles of suffering.

For the millions of victims of the country’s successive wars, Lubanga is just one of many who are responsible for crimes on an astonishing scale. Congolese authorities must end the widespread impunity enjoyed by those who remain in positions of power in the government and military or violence and instability are likely to continue for years to come.

Potential political interference, poor evidence gathering and difficulty accessing remote areas are some of the main challenges to prosecuting economic and environmental crimes related to armed conflict in the Democratic Republic of Congo. Overcoming these challenges was the focus of a two-day workshop for judges and prosecutors in Goma and Bukavu, organized by the International Center for Transitional Justice (ICTJ), in collaboration with the United States Institute for Peace.
