A new book by ICTJ titled Justice Mosaics: How Context Shapes Transitional Justice in Fractured Societies examines the challenges of responding to massive human rights violations in different and difficult circumstances in today's world.

With enforced disappearances on the rise, ICTJ President David Tolbert says the path to prevention is clear: the international community must reorder its priorities and change its approach. The disproportionate attention on counterterrorism takes us further away from accountability and prevention, Tolbert writes. He urges the international community to lead the way in unequivocally censoring governments that use enforced disappearance as a political tactic — and ensuring there can be no impunity for this crime.

Anti-apartheid activist Ahmed Timol died in South African police custody in 1971, and his family continues to demand justice. While police claimed Timol died by suicide, evidence indicated that he was tortured and murdered. The family’s tenacious efforts led to the reopening of an inquest into Timol's death this year, with ICTJ senior program advisor Howard Varney representing the family. Last month the Pretoria High Court ruled in the family’s favor, finding that Timol did not kill himself but was indeed murdered while in police custody. ICTJ’s Sam McCann sat down with Varney to discuss the ruling, what it means to Timol’s family, and its significance for the fight for justice in South Africa.

On September 18, the trial of Dominic Ongwen resumed at the ICC. Ongwen is on trial for 70 counts of war crimes and crimes against humanity – including various forms of sexual violence and the recruitment of child soldiers – committed in the former IDP camps of Lukodi, Odek, Abok, and Pajule during the 20-year insurgency in Northern Uganda. Ongwen is the first former child soldier who is facing trial at the ICC for crimes in which he was also a victim.

New York—On February 26, ICTJ and NYU Law’s Center for Human Rights and Global Justice will welcome former President of Colombia and Nobel Peace Prize Laureate Juan Manuel Santos for a conversation on the role of transitional justice in peace negotiations.

The United Nations Security Council has considered transitional justice on several occasions in the past and included many of its components in country-specific resolutions, and also stressed the links between transitional justice and the other items on its thematic agenda including women, peace and security, and children and armed conflict, and it has made explicit reference to transitional justice as a key part of efforts to sustain peace. Yet, on February 13, the Security Council held its first open debate focusing solely on transitional justice.

This week, the International Criminal Court heard closing arguments in the trial of Dominic Ongwen, a top commander of the Lord’s Resistance Army in Northern Uganda. Among the 70 counts of war crimes and crimes against humanity he faces are 19 counts of sexual and gender-based crimes, including rape, sexual slavery, and forced marriage—the widest range of such crimes ever to be brought to trial before the court. The case thus marks a milestone in the jurisprudence of these international crimes.

Sparing almost no corner of the world from its wrath, the COVID-19 pandemic has now spread to every country. In an effort to slow the contagion, governments in most countries have been taking drastic measures requiring all residents other than essential workers to confine themselves in their homes, and shutting down vast sectors of their economies. On August 4th, former President Alvaro Uribe surprised the country with a tweet announcing that he would be placed under house arrest for suspected witness tampering and obstruction of justice by the Special Instruction Chamber of the Supreme Court of Justice as part of an investigation that has been underway since 2018. According to the court, this decision was made out of a concern for possible obstruction of justice, which appears to be consistent with the ongoing investigation into these same charges. This is undoubtedly an unprecedented situation.

New York, January 25, 2021—"You cannot deliver 500 kilograms of transitional justice,” explains a high-level UN official in a new ICTJ report released today that explores the theoretical and practical challenges of measuring the results of transitional justice processes. These processes are complex and politically contested and are thus notoriously difficult to evaluate. The report offers key insights related to and tools for evaluating and monitoring transitional justice processes and assessing their impact.

On February 4, 2021, the International Criminal Court issued its judgment in the case of the Prosecutor v Dominic Ongwen. The ICC found Ongwen guilty of 61 counts of crimes against humanity and war crimes committed in Northern Uganda between July 1, 2002, and December 31, 2005. The verdict recognizes the enduring impact of the crimes on the victims, their families, and Ugandan society more generally.

Produced by the International Center for Transitional Justice and Cordaid, ‘A Drop of Water on a Hot Stone’: Justice for Victims in the Central African Republic presents findings from a study exploring victim-centered approaches to justice in CAR and their feasibility in a context of profound fragility and extreme poverty.

On March 31, 2021, the Appeals Chamber of the International Criminal Court upheld the Trial Chamber I’s acquittal of former Ivorian President Laurent Gbagbo and Charles Blé Goudé of all charges relating to crimes against humanity they allegedly committed during Côte d’Ivoire’s 2010-2011 post-election crisis. While the acquittal may be frustrating to many pursuing justice and accountability in Côte d’Ivoire, a silver lining is that it could mean tangible benefits for victims.

With a special court that has yet to open a trial and a truth commission that is not up and running, international attention on victims in the Central African Republic is waning. Since 2015, the unfulfilled promises of justice made to these victims have failed to address their daily realities and needs for immediate moral, physical, and material reparations, writes Rim El Gantri, one of the authors of a recent study by ICTJ and Cordaid.

This year marks ICTJ’s 20th anniversary. For the past two decades, the organization has engaged in more than 50 countries, providing technical assistance and other critical support to victims, civil society, governments, and other stakeholders.
