The political crisis in Venezuela seems to have reached a stalemate. In September, the Norway-mediated negotiations between the Maduro government and the opposition came to a halt, leaving both sides struggling for the upper hand. But since it remains difficult for either party to prevail, it is likely that this impasse is a momentary setback rather than an indication that the negotiations are defunct.

In 1998, Colombian filmmaker Sergio Cabrera released “Time Out,” a fictional comedy in which guerrilla members and soldiers — usually mortal enemies — call a momentary truce to watch the national soccer team play in the qualifiers for the 1994 World Cup. Twenty years later, former combatants of both sides, members of the security forces, and victims of the conflict came together at Llano Grande in the region of Dabeiba to watch Cabrera’s film and play a game of soccer.

In countries emerging from violent conflict and repression around the world, prosecutors are facing significant challenges and pressures when seeking to investigate and prosecute serious crimes, such as torture, extrajudicial killings, and enforced disappearance. To reflect on these challenges, ICTJ together with the International Nuremberg Principles Academy, and with support from the governments of Australia and Sweden, convened a side event on December 6, 2019, during the 18th Assembly of State Parties of the International Criminal Court.

On December 12, ICTJ’s head of office for Colombia María Camila Moreno received the Alfonso López Michelsen Award for her dedicated work to advance peace and uphold international human rights and humanitarian law.

Eminent human rights defender José Zalaquett passed away on February 15. “Pepe,” as he was known by many, helped pioneer the field of transitional justice and inspired countless human rights defenders around the globe.

New York—On February 26, ICTJ and NYU Law’s Center for Human Rights and Global Justice will welcome former President of Colombia and Nobel Peace Prize Laureate Juan Manuel Santos for a conversation on the role of transitional justice in peace negotiations.

The United Nations Security Council has considered transitional justice on several occasions in the past and included many of its components in country-specific resolutions, and also stressed the links between transitional justice and the other items on its thematic agenda including women, peace and security, and children and armed conflict, and it has made explicit reference to transitional justice as a key part of efforts to sustain peace. Yet, on February 13, the Security Council held its first open debate focusing solely on transitional justice.

Today, we are facing a global public health crisis of unprecedented proportions. Only time will tell the devastating toll that COVID-19 will exact on human life. The breakneck speed at which the virus is spreading does not give us reason for optimism in the near future. We at ICTJ fully grasp the gravity of the situation, and we take our responsibility for the health and safety of our staff, partners, and communities where we work seriously.

Sparing almost no corner of the world from its wrath, the COVID-19 pandemic has now spread to every country. In an effort to slow the contagion, governments in most countries have been taking drastic measures requiring all residents other than essential workers to confine themselves in their homes, and shutting down vast sectors of their economies. The impact has been crushing. COVID-19 has profoundly affected every country where ICTJ currently works: Armenia, Colombia, Cote d’Ivoire, Ethiopia, Gambia, Kenya, Lebanon, Libya, Sudan, Syria, Tunisia, and Uganda. We recently caught up with ICTJ’s heads of country programs to learn more about the impact the pandemic is having on transitional justice and society more broadly.

It happened again. George Floyd’s name is now added to the tragic list—already far too long—of other people of color whose lives have been cut short as a direct result of the United States’ long history of racism and white supremacy. We at ICTJ are outraged by the cruel and senseless murder of an unarmed Black man by police officers in Minneapolis, Minnesota. As we try to process this horrific act and grieve the tragic loss of another human life, we must also grapple with the hard truth that it is frankly unsurprising that this list of names continues to grow.

In the wake of the mass demonstrations in the United States, activists in European cities similarly took the streets to protest against racism and police violence. In Belgium, mostly young activists have defaced statues of King Leopold II with red paint, insisting public spaces be "decolonized" that commemorate the monarch who personally owned the Congo for more than two decades before relinquishing it to the Belgian government which then controlled it for half a century. Are Belgian and other societies in Europe ready to reckon with the truth of their colonial legacies?

It may seem trivial for me to write about why those who continue to mark July 17 as "International Justice Day" should finally stop calling it that. Many human rights groups (including ICTJ), United Nations agencies, and governments have been publicly using that phrase since 2010. It is for victims of massive and systematic human rights violations, including abuses that amount to international crimes under the Rome Statute, that it is important to end the misconception that the phrase encourages.

On August 4th, former President Alvaro Uribe surprised the country with a tweet announcing that he would be placed under house arrest for suspected witness tampering and obstruction of justice by the Special Instruction Chamber of the Supreme Court of Justice as part of an investigation that has been underway since 2018. According to the court, this decision was made out of a concern for possible obstruction of justice, which appears to be consistent with the ongoing investigation into these same charges. This is undoubtedly an unprecedented situation.

As UN member states convene virtually this week for the annual General Assembly, they will likely focus on a narrow list of agenda items, topped by issues related to the deadly coronavirus pandemic and a global economic downturn. For this reason, ICTJ would like to recall the vital importance of justice for global peace, security, health, and development by sharing findings from an analysis of the open debate on transitional justice that the UN Security Council held on February 13, 2020, as part of its peacebuilding and sustaining peace agenda.

On September 14, the former Revolutionary Armed Forces of Colombia (FARC) publicly apologized to the victims of the kidnappings they perpetrated during the armed conflict. This unprecedented public declaration from a non-state armed group merits reflection from both the perspective of the transitional justice field as a whole and its implications for Colombia.

The political crisis in Venezuela has reached a breaking point. The upcoming parliamentary elections scheduled for December 6 threaten to deprive the opposition of its institutional foothold, on which the legitimacy of its demand to establish an interim government rests. Moreover, observers both inside and outside Venezuela have repeatedly warned that the conditions are unsuitable for fair and impartial elections. A political solution now depends on the government backpedaling from its recent refusal to postpone the elections and allowing the European Union to observe them. It also requires the opposition to take a clear stance beyond calling for the removal of the president.

The purpose of Resolution 1325 is to highlight the particular way in which women and girls suffer in situations of conflict, as well as the critical role they play in peacebuilding. To commemorate the 20-year anniversary of the resolution, ICTJ would like celebrate the life and work of one its own women peacebuilders: María Camila Moreno Múnera, head of ICTJ’s Colombia office. She exemplifies what a woman leader can achieve in advancing truth, justice, reparation, and peace.

Bogotá, November 20, 2020—ICTJ and the Movement of Latin American Hip Hop Expressions have joined forces to cohost the third International Hip Hop Encounter, which will take place virtually this week from November 25 to November 28. The four-day online event will bring together artists and musicians from across Latin America and Africa along with activists, social leaders, and civil society representatives. The festival’s theme is the role of hip hop music and culture in uncovering truth, preserving memory, and resisting violence and oppression.

In what UN Women describes as the “shadow pandemic,” rates of violence against women have soared since the public health and economic crises brought about by COVID-19. With stay-at-home orders in place in countries around the world, women are more susceptible than ever to domestic violence. In countries affected by conflict or repressive rule, all forms of sexual and gender-based violence are on the rise. The ICTJ Gender Modules offer a timely tool to raise awareness about these issues and help develop gender-sensitive responses to them.

For many victims of human rights violations and international crimes around the world, the prospects of holding perpetrators to account, especially high-level individuals, have long seemed farfetched, given current political and legal hurdles and the limitations of international criminal justice mechanisms. For this reason, the multiple ongoing investigations into international crimes committed in Syria and court cases against suspected perpetrators based on the principle of universal jurisdiction across Europe have offered a ray of hope in an otherwise bleak justice landscape.

In Venezuela, there is now an absence of representative democracy and a vacuum of public trust in politicians. However, this situation presents an opportunity for other actors and other approaches, so far disparaged by hardliners on both sides. Civil society organizations, which have earned credibility through their dedicated work addressing the humanitarian crisis and defending human rights, can seize this opportunity.

New York, January 25, 2021—"You cannot deliver 500 kilograms of transitional justice,” explains a high-level UN official in a new ICTJ report released today that explores the theoretical and practical challenges of measuring the results of transitional justice processes. These processes are complex and politically contested and are thus notoriously difficult to evaluate. The report offers key insights related to and tools for evaluating and monitoring transitional justice processes and assessing their impact.

2020 was a year of unforeseen hardships throughout the world. We may wish to write off last year as a loss and move forward. However, looking back on it as we do in this 2020 Year in Review, in which we highlight our most read content, we can find and take heart in important victories and apply lessons learned in 2021 and beyond.

A significant portion of Colombian society has been indifferent to the pain of those who lived through the war in the flesh. Some have even denied the existence of an internal armed conflict. This is why it is necessary for us to recount our early and recent history. A new, more comprehensive and nuanced narrative must emerge from the testimonies of victims, responsible parties, and even spectators of this unending war.

This year marks ICTJ’s 20th anniversary. For the past two decades, the organization has engaged in more than 50 countries, providing technical assistance and other critical support to victims, civil society, governments, and other stakeholders. Since its beginnings, ICTJ has served as a meeting point for transitional justice experts and practitioners and a hub of knowledge, research, and analysis. As a think tank that does, it has been at the forefront of the field’s evolution.

The millions of Syrians displaced by the grinding decade-long war have sought out safety far and wide, in safe havens within the country, in neighboring countries in the region, and further afield. Those who managed to reach Europe often did so against the odds and often after experiencing displacement more than once. Now, one of these countries, Denmark , is taking away from Syrians living in its borders the protection they so desperately sought and still need and, with it, the tiny bit of hope that they have worked so hard to preserve.

While Armenia may rightfully seek acknowledgment from its neighbors of the genocide and other egregious violations, for its part, it must have the courage to reckon with its own recent past in the 30 years since achieving statehood, which includes war crimes, systematic corruption, and large-scale human rights abuses against its own citizens. Failing to do so ultimately threatens the young republic’s democracy.

“No peace without justice” is a chant that filled the streets of the United States last year following the murder George Floyd by police in May 2020. This same chant has animated protest movements and social and political upheaval in many countries around the world. We at ICTJ know from our experience that these calls for justice are for something far more encompassing than criminal accountability alone.

Alonso Ojeda Awad and Medardo Correa joined Colombia’s notorious leftist guerrilla group the National Liberation Army (ELN) in their youth. After fighting with the group for several years, they and a handful of other ELN members demobilized voluntarily in the 1980’s. But it was not until 2019 that they were able to sit down with former members of paramilitary groups to discuss acknowledgment and responsibility for past crimes, reparation, and the importance of non-recurrence.

Expectations for advancing much-needed justice and dismantling state and non-state criminal networks that persistently violate human rights have been dashed over the past three years in Mexico. Violence and impunity have increased. President Andrés Manuel López Obrador's campaign promises have not materialized in a serious effort to address the lack of security in the country or the justice system’s inefficiency. However, several efforts have persisted, characterized by cooperation among state institutions, civil society, and victims’ groups that not only give hope, but confirm the way forward.

The Maryland Lynching Truth and Reconciliation Commission held its first public hearing in Cumberland, Allegany County, Maryland, on October 2, 2021. The event, broadcast live from Emmanuel Episcopal Church, brought together commissioners, panelists, and guests to acknowledge and memorialize the tragic lynching of 18-year-old Robert Hughes (aka William Burns) in Cumberland in 1907. In the coming months, the commission will convene several more of these public hearings in counties across the state of Maryland.

When reflecting on peace agreements and their implementation, it is tempting to begin by saying that these processes are generally slow and complex. While that may be true in many contexts, it contributes little to the discussion about what has happened in Colombia since the government signed a final peace deal in November 2016 with the Revolutionary Armed Forces of Colombia, or FARC-EP—the oldest and largest guerrilla group in the county—that ostensibly ended 50 years of war.

New York, January 21, 2022—ICTJ will host an online course, entitled “Prevention and Guarantees of Non-Recurrence: The Role of Transitional Justice,” from March 14 through 18, 2022. Prevention has emerged as a top priority on international policy agendas for sustainable peace and development and global governance, and understanding the preventive capacity of transitional justice is more imperative than ever.

In 2021, there were significant developments, some hopeful and some devastating, in the struggle for truth, accountability, and redress in countries around the world. ICTJ experts covered these events in commentaries and feature stories published on our website and in our newsletters. While 2022 is already underway and we at ICTJ are hard at work, we would like to pause a moment to take stock and reflect on the year that was.

The start of 2022 was marked by two important victories in the fight for justice and redress for victims of human rights violations in Syria. On Thursday, January 13, 2022, the Higher Regional Court in Koblenz, Germany, convicted Anwar Raslan, a senior official in the Syrian government, for crimes against humanity. The landmark trial, the first ever to prosecute a member of Bashar al-Assad’s regime for such crimes, highlights a crucial component without which Raslan would never have been convicted: the role of victims in achieving justice.

In the latest round of negotiations between Ukraine and Russia, the Turkish president called on both delegations to act responsibly and agree to a ceasefire. He reminded them of their historical mission to achieve a "just peace." While we may not know how and when this conflict will end, we already know some of what Ukrainian society will be grappling with in the near future. Significant portions of country’s civilian infrastructure have been destroyed. More than 4 million Ukrainians are now refugees; another 10 million are internally displaced; and a rising but still undetermined number have been killed, are missing, or are wounded. The real question is what does a just peace mean for Ukrainians.

On June 21-23, Colombia’s Special Jurisdiction of Peace (JEP) held its first acknowledgment hearing on the taking hostages, serious deprivation of liberty, and other concurrent crimes (known as Case 01) in Bogotá. Seven former leaders of the guerrilla group Revolutionary Armed Forces of Colombia—People’s Army (FARC-EP) acknowledged their command responsibility for the kidnapping crimes that were the FARC-EP’s policy from 1993 to 2012 in the presence of victims, JEP officials, civil society representatives, and members of the press. This hearing marks the first time ever FARC-EP leaders publicly acknowledged their role in such systemic crimes. A decisive step in the country’s restorative justice process, it would not have been possible without years of preparation.

On October 31, Armenian Prime Minister Nikol Pashinyan met with Russian President Vladimir Putin and Azerbaijani President Ilham Aliyev in Sochi to discuss steps to normalize relations between Yerevan and Baku and a longer-term peace deal that would finally end the decades-long, on-and-off conflict over Nagorno-Karabakh. This willingness on both sides to come to the negotiating table is without question welcome news. However, the two parties seem to want to talk about peace on different terms and without addressing core human rights issues in their respective countries in connection with the conflict.

The United States has never collectively confronted its history of colonialism, slavery, and racism in an effort to reform the systems that perpetuate harms to Black communities and other marginalized groups, or to redress these wrongs. Events in recent years, however, have amplified calls for meaningful action to reckon with the past. Given that truth seeking is integral to the investigation of past wrongs, ICTJ and a coalition of practitioners from multiple law firms has released a new report that examines the experiences of official truth commissions from around the world to identify relevant considerations for US stakeholders.
